Please read this Agreement carefully. It affects your legal rights, including your right to sue for injuries caused by ordinary negligence.
1.Parties and services covered
This Participant Agreement, Assumption of Risk, and Release of Liability (“Agreement”) is between me, the participant accepting it (“I” or “Participant”), and INTEGRIT Performance and Nutrition LLC, a Wisconsin limited liability company doing business as Overload Strength and Overload Strength Training (“Overload Strength”).
In this Agreement, “Released Parties” means Overload Strength, its owners and members (including Patryk Piekarczyk), employees, and the independent contractor coaches and trainers it engages.
This Agreement applies to all services I receive from Overload Strength, now and in the future, until I revoke it in writing. These services (“Activities”) include:
- One-on-one personal training, including the Personal Training Kickoff Session
- Small group training
- Open gym access, supervised or unsupervised
- Movement screens, fitness assessments, and body composition testing
- Remote and online coaching, including programs delivered through apps such as Everfit
- Nutrition coaching and counseling
- Workshops, challenges, community events, and fundraisers organized by Overload Strength
2.Risks of participation
I understand that strength training, conditioning, and exercise involve real risks of injury. These risks include, but are not limited to:
- Muscle strains, sprains, tears, joint injuries, back injuries, and fractures
- Injuries from lifting, dropping, or being struck by weights, barbells, kettlebells, or other equipment
- Injuries from slips, trips, falls, or equipment failure
- Dizziness, fainting, overheating, dehydration, and exhaustion
- Heart attack, stroke, abnormal heart rhythm, and in rare cases death
- Aggravation of existing injuries or medical conditions
- Injury from the actions of other people training nearby
I understand that some of these risks cannot be eliminated without changing the nature of the Activities. I also understand there may be risks that are not known or foreseeable today. My participation is voluntary.
3.Health disclosure and readiness
I agree to tell Overload Strength, before I participate and whenever something changes, about any injury, medical condition, surgery, pregnancy, or medication that could affect my safety. This includes heart or blood pressure conditions, diabetes, joint or back problems, and prescription weight-loss or diabetes medications.
I understand that Overload Strength may ask me to get clearance from my physician before participating, and may limit or pause my participation until I do.
I agree to stop exercising and tell my coach right away if I feel chest pain, unusual shortness of breath, dizziness, faintness, or pain beyond normal training discomfort.
I understand that Overload Strength’s coaches are not physicians, and that a fitness assessment or movement screen is not a medical examination or diagnosis.
4.Assumption of risk and release of liability
Assumption of risk. I knowingly and voluntarily accept the risks described in Section 2, including risks caused by my own actions and the actions of other participants.
What I am releasing. In exchange for being allowed to participate, I release the Released Parties from claims for injury, illness, death, or property damage arising from my participation in the Activities that are caused by the ordinary negligence of the Released Parties. I agree not to sue the Released Parties for those claims. This release also binds my heirs, executors, and anyone who might bring a claim on my behalf.
What I am not releasing. This release does not apply to claims caused by gross negligence, recklessness, or intentional misconduct by any Released Party, or to any claim that cannot be released under Wisconsin law.
In plain terms: if I get hurt because a coach made an ordinary mistake, I agree not to sue. If I get hurt because someone acted recklessly or on purpose, this Agreement does not stop me from bringing a claim.
5.Facility, contractors, open gym, and remote coaching
Shared facility. Overload Strength operates inside a facility owned by M.E. Initiative, LLC d/b/a Wolf Pack Combat Academy (“WPCA”). WPCA and Overload Strength are separate, unaffiliated businesses. WPCA may require me to sign its own waiver, and this Agreement does not replace it.
Independent contractors. Overload Strength may use independent contractor coaches and trainers. They are Released Parties under this Agreement to the same extent as Overload Strength’s owners and employees.
Facility safety. I agree to follow posted rules and coach instructions, use equipment only as instructed, return equipment after use, and report any unsafe equipment or conditions to a coach right away. I will not use equipment I believe is unsafe.
Open gym. I understand that open gym is unsupervised. During open gym, I am responsible for choosing my own exercises, loads, and spotting, and for training within my abilities. I agree not to attempt maximal lifts without a qualified spotter or proper safety equipment.
Remote and online coaching. For remote coaching, I choose where I train and what equipment I use, and no coach is present to supervise me. I am responsible for the safety of my training environment and equipment, and for following my program as written or asking questions before changing it.
6.Nutrition services
Nutrition coaching may be provided by a registered dietitian or by coaches working under a dietitian’s guidance. I understand that:
- Nutrition coaching supports my fitness and health goals. It is not a substitute for care from my physician, and it does not diagnose or treat disease unless separately agreed in writing as medical nutrition therapy.
- I am responsible for telling Overload Strength about any food allergies, intolerances, eating-related medical conditions, and medications, including GLP-1 or other weight-loss medications.
- If I take medication or have a medical condition, I will check with my prescribing provider before making major changes to my diet or supplements.
- Any supplement suggestions are general guidance. I choose whether to use them and am responsible for reading labels and checking with my physician.
- Results vary and are not guaranteed.
7.Medical emergencies, indemnity, and general terms
Medical emergencies. I authorize Overload Strength to call emergency services and arrange first aid or medical treatment for me if I am injured or have a medical emergency. Overload Strength will make reasonable efforts to contact my emergency contact. I am responsible for the cost of any treatment.
Indemnity. I agree to reimburse the Released Parties for losses, including reasonable attorney’s fees, caused by claims brought by other people that arise from my own negligent or intentional conduct during the Activities.
Opportunity to review and negotiate. I have had the chance to read this Agreement, ask questions, and have it reviewed by an attorney before accepting it. If I want to discuss or propose changes to any term, I may contact Overload Strength at coaching@overloadstrength.com before accepting, and Overload Strength will consider my request in good faith. Any agreed changes must be in writing.
Separate agreement. This Agreement is a standalone document about risk and liability. Membership, payment, and cancellation terms are covered in separate agreements.
Electronic signature. I agree that checking a box, typing my name, or signing electronically has the same effect as a handwritten signature.
Governing law. This Agreement is governed by Wisconsin law. If any part is found unenforceable, the remaining parts stay in effect, and the unenforceable part will be enforced to the greatest extent the law allows.
Duration. This Agreement covers all my participation with Overload Strength from the date I accept it until I revoke it in writing.
8.Acknowledgment and acceptance
I HAVE READ THIS AGREEMENT AND UNDERSTAND IT. I UNDERSTAND THAT BY ACCEPTING IT, I AM GIVING UP MY RIGHT TO SUE THE RELEASED PARTIES FOR INJURIES CAUSED BY THEIR ORDINARY NEGLIGENCE. I AM ACCEPTING IT FREELY AND VOLUNTARILY.
How I accept. I accept this Agreement by checking the agreement box at checkout, by signing it electronically, or by signing a paper copy. My acceptance is recorded with the date and time.
Participants under 18
A parent or legal guardian must accept this Agreement on behalf of any participant under 18. By accepting, the parent or guardian confirms they have read this Agreement, consent to the participant’s participation, and agree to its terms on the participant’s behalf and their own.
Photo and video consent
Photo and video consent is optional and is not part of this Agreement. Overload Strength will ask for it separately, and I may say no without affecting my participation. If I give consent, I may withdraw it in writing at any time for future use.
